1. Acceptance of Terms

By downloading, installing, or using the Brain Ripe mobile application (the “App”), you (“User”) agree to be bound by these Terms of Use and the Privacy Policy of Brain Ripe UG (“we”, “us”, or “our”). If you do not agree, do not use the App.

When you tap “Get Started” or similar within the App, you confirm that you have read, understood, and accepted these Terms and the Privacy Policy. You also confirm that you are at least 13 years old.

2. Eligibility

The App is intended for users aged 13 years or older. By using the App, you represent and warrant that you meet this age requirement.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use the App on your compatible device in countries where the App is legally available. This license is for personal, non-commercial use only.

You may not:

  • Reproduce, distribute, modify, or create derivative works of the App.
  • Reverse engineer, decompile, or attempt to extract the source code.
  • Use the App in any unlawful or unauthorized manner.

4. User Accounts and Data

  • The App creates an anonymous device-based account with a user-selected username.
  • You control your username and friend list.
  • The App collects and shares your screen time and ranking data only with friends you accept.
  • You may report inappropriate usernames through the reporting features available.
  • We reserve the right to edit, suspend, or delete usernames or accounts that violate these Terms, including offensive or inappropriate content.

5. Prohibited Conduct

You agree not to use the App to:

  • Violate any laws or third-party rights.
  • Harass, threaten, or harm other users.
  • Manipulate rankings or misuse the App’s features.
  • Upload offensive or inappropriate usernames.

6. Termination

We may, at our sole discretion, suspend or terminate your access to the App, or delete your account and data, without prior notice, if you violate these Terms or for any reason deemed necessary.

7. Disclaimers and Limitation of Liability

  • The App is provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not guarantee that the App will be error-free, uninterrupted, or free of viruses.
  • The screen time data and rankings are based on Apple’s Screen Time API and other sources and may not be 100% accurate.
  • Brain Ripe UG is not responsible for any damages arising from your use of the App or reliance on its data.
  • We are not liable for the content or privacy practices of any external links within the App.
  • You use the App at your own risk.

8. Intellectual Property

All rights, titles, and interests in the App and its content, including software, graphics, logos, and trademarks, are owned by Brain Ripe UG or its licensors.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Munich, Germany.

10. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted within the App and take effect immediately upon posting. Your continued use of the App constitutes acceptance of the revised Terms.
